on

Temperature in the Workplace

 

            Minister of Social Affairs, Labor, Vocational Training and Youth Rehabilitation

-         Having seen the Constitution of the Kingdom of Cambodia;

-         Having seen Pras Reach Kret No NS/RKT/1198/72 dated November 30,1998 on the appointment of the Royal Government of the Kingdom of Cambodia;

-         Having seen Pras Reach Krom No 02/NS/94 dated July 20, 1994 promulgating the law on organization and functions of the Council of Minister

-         Having seen Pras Reach Krom No CS/RKM/0397/01 dated March 13, 1997 promulgating the Labor Law;

-         Having seen Pras Reach Krom No NS/RKM/0699/06 dated June 17, 1999 promulgating the law on the creation of the MoSALVY;

-         Having seen Anukret No 87/ANK/BK dated October 04, 1999 on the organization and functions of the MoSALVY.

 

Decides

Article 1 : Employers of enterprises and establishments stated in Article 1 of the Labor

Law must take measures to ensure that the temperature in the workplace is always at a tolerable level. This temperature should be at a level which is reasonable considering the health of the workers and should not disturb their work. This temperature should be measured by a thermometer which is located in the workplace.

 

Article 2 : Buildings or workshops must have at least 10 cubic meters of airspace per worker. The workplace should be protected from the heat of the sun. A method of production which does not produce heat should be a right. If the method of production does produce hear the employer must reduce this heat by:

 

Article 3 : In the case that the temperature in the workplace rises a lot causing problems to employee health or cause problems for workers in carrying out their work, the employer must take all measures to ensure that the workplace becomes cool again such as fans or air conditioners for example.

 

Article 4 : Workers who work in very cold environments shall have the right to receive appropriate protection such as thick clothing, hats and gloves for example.

 

Article 5 : Any infringement to the provision therein shall be fined or punished according

to the Chapter 16 of Labor Law.

 

Article 6 : This Prakas shall come into force from of its signature.
